    The Gauteng High Court will on Tuesday hear an urgent application brought by the uMkhonto weSizwe (MK) Party, challenging the appointment of Firoz Cachalia as acting police minister.

    The party argues that the Constitution makes no provision for the position of an “acting minister.” Cachalia was appointed on 1 August after Senzo Mchunu was placed on indefinite leave.

    “The Constitution does not make provision for an acting minister position,” the MK Party stated.

    The MK Party is also challenging President Cyril Ramaphosa’s decision to establish a commission of inquiry into alleged corruption within the crime prevention sector.

    The party wants the court to declare both Cachalia’s appointment and the establishment of the inquiry as “unconstitutional and invalid.”

    This latest court bid comes after the Constitutional Court dismissed a similar MK Party application in July, citing a lack of direct access.

    Cachalia took over the ministry following serious allegations against Senzo Mchunu by KwaZulu-Natal Police Commissioner Nhlanhla Mkhwanazi.

    These claims prompted Ramaphosa to set up a commission of inquiry, which is now under legal challenge by the MK Party. The inquiry is tasked with investigating alleged corruption within the crime prevention sector.
