Retired Justice Anthony Kennedy’s memoir, Life, Law and Liberty, comes out today, Oct. 14. Within the next few weeks, SCOTUSblog will publish a review of the book. To whet readers’ appetites, however, below are several interesting passages from it (or, at least, passages that I found to be interesting), including reflections on originalism, Kennedy’s most controversial cases, abortion, Vladimir Putin, and music. On judicial decision-making: Let’s begin with judicial decision-making. Throughout his memoir, Kennedy stresses the value of judicial humility and integrity in deciding cases, and he emphasizes that the “Court earns its respect not because its decisions are…

The Trump administration is looking for alternative ways to ensure federal law enforcement officers are paid as the government shutdown enters its third week. With Democrats and Republicans locked in a stalemate over the shutdown, officials in government are exploring alternative ways of paying for some key programmes, including a food programme for women and children. Members of the US military, meanwhile, will be paid using funds previously allocated to the Pentagon following an order from President Donald Trump.Thousands of federal workers have already been laid off, with Vice-President JD Vance warning of further “painful” cuts should the shutdown continue.…
The Supreme Court on Tuesday morning turned down a plea from conservative media personality Alex Jones to hear his appeal of a Connecticut case brought by families of the children killed at Sandy Hook Elementary School more than a decade ago, in which he was found liable for defamation and emotional distress. The court also rejected an appeal by several Colorado parents, who contend that a school district in that state violated their constitutional rights when they excluded them from discussions of their children’s gender identity. The announcements came as part of a list of orders released by the Supreme…

Justice, Democracy, and Law is a recurring series by Edward B. Foley that focuses on election law and the relationship of law and democracy. Justice Amy Coney Barrett’s new book, Listening to the Law, is an excellent read. I’ve strongly recommended it to my students and agree with Will Baude that it’s the best “single book” right now “to give to any lay person who wanted to understand the Court.” (I’m looking forward to reading Justice Anthony Kennedy’s book for comparison.) In her book, Barrett makes a cogent case for originalism as the correct method of constitutional interpretation. In her…
