    Zuma And MK Party Urge Court Not To Dismiss Case Against Ramaphosa On ‘Technicality’

    Lawyers representing former President Jacob Zuma and the uMkhonto weSizwe (MK) Party have urged the Pretoria High Court not to dismiss their case against President Cyril Ramaphosa on what they call a “technicality.”

    The court is currently considering whether the MK Party’s challenge to Ramaphosa’s decisions is urgent. At the centre of the dispute is the establishment of the Judicial Commission of Inquiry into the Police and the appointment of Professor Firoz Cachalia as Acting Police Minister.

    Dali Mpofu Accuses Ramaphosa Of Dodging Merits

    Representing the MK Party, Advocate Dali Mpofu argued that President Ramaphosa is attempting to avoid having the substantive issues heard in court.

    “The president’s lawyers have argued that the matter is not urgent, as the commission of inquiry has already commenced and Professor Firoz Cachalia has been appointed,” Mpofu said.

    He urged the court not to give Ramaphosa another ruling based on a technicality, highlighting that the Constitutional Court had previously denied Zuma and the MK Party direct access on similar grounds.

    Madlanga Commission.

    The matter is being heard by a full bench led by Acting Deputy Judge President Letty Molopa-Sethosa. The judges are expected to deliver a ruling on urgency on Thursday afternoon.

    That decision will determine whether the merits of the MK Party’s case against Ramaphosa will be heard in court today.
