A top European Union court ruled in favor of Ikea on Tuesday in a challenge brought by the company against Belgian far-right and Flemish separatist party Vlaams Belang.
The popular Swedish brand may prevent the Belgian party from using its signature illustrations. Vlaams Belang <a href="https://absafricatv.com/siri-ais-beta-buzz-fades-ahead-of-full-launch/” title=”Siri AI's Beta Buzz Fades Ahead of Full Launch”>launched the “Ikea Plan” in 2022, a proposal to reform the country’s migration and asylum laws.
The plan included images similar to Ikea’s furniture assembly instructions. Ikea filed a legal complaint in 2023, accusing the far-right party of unlawfully using its branding.
What did the court rule?
“A proprietor of a trademark with a reputation may prevent that mark from being used by a political party where the latter has not demonstrated that its freedom of expression takes precedence over the rights and interests of that proprietor,” the ECJ court said in a statement.
Vlaams Belang argued that the campaign was protected under freedom of expression. However, the Luxembourg-based Court of Justice found this argument insufficient, ruling that the use of Ikea’s branding could harm the company’s name and reputation.
The Luxembourg judges urged the Belgian court to issue a ruling on the matter in light of the decision by the European Court of Justice.
What did Vlaams Belang and IKEA say about the ruling?
In a statement, Vlaams Belang said it had taken note of the judgement, adding that it “will thoroughly study its scope in the context of the further legal proceedings.”
Meanwhile, IKEA representatives welcomed the judgement.
“Inter IKEA strongly believes in and has great respect for freedom of expression. At the same time, the company cannot accept the use of IKEA’s trademarks in a way that harms their reputation or distinctiveness”, Inter IKEA, a Netherlands-based holding company that handles the Swedish firm’s intellectual property, was cited by Reuters news agency as saying.
Besides its anti-immigration stances, Vlaams Belang also advocates for the independence of Flanders — the northern, Dutch-speaking part of Belgium.
While it made considerable gains in 2024 elections, other parties refuse to cooperate with it.
