European Commission says it has received Puigdemont’s complaint against Spain but avoids commenting for now

The European Commission has said that it is up to Spain’s Court of Auditors and National Court to implement the ruling of the Court of Justice of the European Union (CJEU) that upheld the amnesty law.
In a statement, a spokesperson for the EU executive confirmed that Brussels had received the complaintfiled by former Catalan president Carles Puigdemont’s lawyer, Gonzalo Boye, against Spain for not implementing the law.
However, the executive avoided commenting on the content of the claim. Brussels will now examinethe complaint before making a decision, as established by the procedure.
Regarding the ruling of the CJEU, the European Commission spokesperson reiterated that they are aware of the decision of the European court and stressed that “it is up to the referring courts to apply the rulings” of the CJEU.
Puigdemont has filed a complaint against Spain with the European Commission together with former ministers Toni Comín and Lluís Puig. The letter reacts to the decision of the Spanish Court of Auditors not to apply the amnesty.
In the complaint, Puigdemont, Comín and Puig explain that they have requested the Court of Auditors to apply the amnesty “immediately.”
For now, Puigdemont’s complaint has not yet been formally registered, butprocess it and begin the process to determine whether it is necessary to open a sanctions procedure against Spain for violating EU law
