    How much tourism can one of the world’s most famous protected areas sustain? This question has once again taken centre stage in the debate in Kenya following a new legal case calling for a halt to the expansion of accommodation facilities in the Maasai Mara until at least 2032. Every year, over a million wildebeest, zebras and gazelles cross the Mara River in what is considered one of the most extraordinary natural spectacles on the planet. Today, however, Africa’s most famous migration risks becoming a symbol of the clash between conservation and luxury tourism.

    The Maasai Mara National Reserve is once again at the centre of a sensitive dispute between tourism development and environmental protection. A group of environmental and legal organisations from East Africa has filed a new appeal with Kenya’s Environment and Land Court, calling for a halt to any new construction or expansion of accommodation facilities within the reserve until 2032

    The legal action, brought by the East Africa Law Society together with Natural Justice, JustAct and the Africa Centre for Peace and Human Rights, argues that the continued expansion of luxury tourism is endangering one of the African continent’s most precious ecosystems and interfering with the spectacular Great Migration, during which over a million wildebeest, accompanied by hundreds of thousands of zebras and gazelles, cross the border between Tanzania’s Serengeti and the Maasai Mara every year.

    According to the applicants, not only should all new tourism projects be halted, but some existing lodges are operating without fully complying with the planning and environmental regulations set out in the reserve’s management plan. Among the establishments cited are the new Ritz-Carlton Maasai Mara Safari Camp, which opened last year, Sala’s Camp and the Sand River Masai Mara by Elewana

    The case follows a previous appeal, lodged in 2025, which had unsuccessfully sought to prevent the opening of the Ritz-Carlton lodge, an exclusive property managed by the Marriott International group. Even then, environmentalists and local organisations had argued that the resort was situated in a sensitive area for the passage of migrating animals, an accusation rejected by the Kenya Wildlife Service

    The new proceedings also name the Narok County Government, the National Environment Management Authority (NEMA) and other public bodies as defendants, accusing them of authorising certain projects without an adequate environmental impact assessment and in breach of the Maasai Mara Management Plan 2023–2032, which had provided for a moratorium on the construction of new tourist accommodation precisely to limit pressure on the ecosystem

    Many Maasai herders have also sided with the environmentalists, complaining that the growing presence of exclusive lodges, private roads and safari infrastructure is encroaching on the land traditionally used for grazing and profoundly altering their way of life

    The debate comes at a particularly sensitive time. Tourism is, in fact, one of Kenya’s mainl of the African safari, a favourite destination for visitors from all over the world. Yet it is precisely its success that risks becoming its greatest threat

    The first hearing has been scheduled for 20 July. Not only the future of certain exclusive lodges, but also the delicate balance between economic development, wildlife conservation and the protection of local communities in one of the world’s most famous nature reserves could hinge on that date
