South Africa has dismissed a petition to the International Criminal Court (ICC) alleging crimes against humanity over xenophobic violence.
The government said the application by two Ghanaian nationals was legally flawed and insisted the country had robust laws to deal with hate crimes and discrimination.
The petition argued that repeated attacks on foreign nationals amounted to a widespread and systematic pattern of violence and followed months of anti-immigrant protests, some of which turned violent.
But the Department of International Relations and Cooperation (DIRCO) described the application as opportunistic.
DIRCO spokesperson Chrispin Phiri said: “SA notes this filing fails to satisfy the statutory legal triggers and jurisdictional requirements necessary for action by the court. SA maintains full confidence in its domestic legal framework.”
