    First-of-its-kind tribunal to test Free State judge’s medical fitness for the bench

    A first-of-its-kind judicial tribunal is set to get underway on Wednesday to determine whether a Free State high court judge is medically fit to remain on the bench.

    Judge Lepono Lekale has been on sick leave since 2018 due to an eye condition, making this the first judicial incapacity inquiry in the history of South Africa.

    The outcome could determine whether the judge faces impeachment and removal from office.

    The tribunal will hear evidence from Free State Judge President Cagney Musi, who lodged the complaint, as well as from Judge Lepono Lekale himself.

    The inquiry is expected to hear from medical experts, including the ophthalmologist who has treated Lekale since 2018.

    This, while his traditional healer may also testify.

    The panel must decide whether Lekale’s medical condition has left him incapable of performing his duties as a judge.

    If it finds that he is judicially incapacitated, the matter will be referred to the Judicial Service Commission, which could recommend that Parliament begin the constitutional process to remove him from office.
